Terms of Service

These Terms of Service govern your use of hookwebdesign.com and all HookWeb Design services, including the Smart Growth System™ and its six engines: Conversion Website™, Digital Front Desk™, Chat & Social Receptionist, Reputation & Local SEO, Social Media Management, and Inbox Automation. By engaging our services, scheduling a strategy call, or accessing our site, you agree to these Terms.
1. Acceptance of Terms
By accessing or using our website, submitting intake forms, or enrolling in our services, you confirm that you are at least 18 years of age and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.
2. Services & Scope of Work
HookWeb Design provides done-for-you automation, including the Conversion Website™, Digital Front Desk™ voice and chat automations, Chat & Social Receptionist, Reputation & Local SEO, Social Media Management, Inbox Automation, and related digital growth systems. Detailed scope, onboarding milestones, and timelines are established upon engagement. We reserve the right to modify, suspend, or enhance any service feature with appropriate notice.
3. Fees, Billing & Payment Terms
One-time setup fees (also called the Implementation & Launch Fee) and recurring monthly fees are shown on our Services page and on your order form at the time you purchase. The order form controls if anything differs. Fees are billed in advance. Invoices are payable upon receipt via credit card or approved ACH. Late payments may result in suspension of automated services.
4. Cancellation & 100-Day Performance Guarantee™
All monthly plans operate on a flexible month-to-month basis with no long-term contract lock-in. You may cancel any monthly service with written notice to info@hookwebdesign.com before the next billing cycle. Annual plans are billed upfront for the full term and are governed by Section 6 of our Refund & Cancellation Policy, which controls if it differs from this section. The Smart Growth System™ is backed by our 100-Day Performance Guarantee™. The timeline, scorecards, conditions and refund formula are set out in our Refund & Cancellation Policy, which is part of these Terms and controls the guarantee. One-time setup fees are non-refundable once engineering work has begun.
5. Client Cooperation & Content
Timely delivery of our systems requires your cooperation. You agree to provide necessary logos, business information, access credentials, and review approvals promptly. You represent that all content you provide does not infringe on third-party intellectual property rights.
6. Communications & TCPA Consent
By providing your phone number, email address or other contact details on our website, through our automation widgets, or on a demo form, you expressly authorize HookWeb Design LLC to contact you by phone call, text message (SMS) and email about our services. This includes sales, follow-up and appointment-scheduling messages, as well as transactional and operational messages. Calls and texts may be placed using automated technology, including artificial-intelligence voice and chat assistants. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. You may opt out of texts at any time by replying STOP. To stop calls or emails, tell us on a call or email info@hookwebdesign.com.
7. Intellectual Property
HookWeb Design retains all proprietary rights, trademarks, workflows, templates, and automation architectures developed by us. Upon full payment of all fees, custom deliverables created specifically for you are licensed for your business use.
8. Limitation of Liability & Disclaimer
To the fullest extent permitted by applicable law, HookWeb Design and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenue. Our aggregate liability arising out of or related to these Terms will not exceed the total fees paid by you to HookWeb Design in the three (3) months preceding the incident.
9. Governing Law, Arbitration & Dispute Resolution
These Terms and any dispute arising out of or related to the Services are governed by the laws of the State of Missouri, without regard to conflict of laws principles. Binding Arbitration: Except for IP injunctive relief, any dispute will be resolved by binding arbitration administered by the American Arbitration Association ('AAA') under its Commercial Arbitration Rules. Arbitration will be held in St. Louis County, Missouri, and parties may appear virtually. Jury Trial Waiver: To the extent any dispute is properly brought in court, each party waives any right to a trial by jury.
10. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, along with your engagement agreement, constitute the entire agreement between you and HookWeb Design.
11. Demo Notice
This demo is a sample created to show how HookWeb Design systems work. It is not a live service for your business, is not covered by the 100-Day Performance Guarantee™, and does not promise any results. The guarantee begins only after an engine goes live, and it measures scorecard targets only. We do not guarantee leads, sales, revenue, rankings or follower counts.
