1. Agreement to Terms

By purchasing, accessing, or using services from HookWeb Design (“Company,” “we,” “our,” or “us”), including the Smart Growth System™, you agree to these Terms of Service.

2. Services Provided

HookWeb Design provides automated lead capture, response, and conversion systems, including but not limited to:

Missed-call text-back systems

Automated receptionist systems

Website lead conversion systems

Follow-up automation

CRM and communication integrations

Services may include a launch/setup phase and ongoing subscription access.

3. Launch Setup Fee

For monthly subscription clients, a one-time $2,500 Launch Setup Fee applies.

This fee covers system buildout, onboarding, configuration, integrations, testing, and implementation.

The Launch Setup Fee is non-refundable, except where expressly stated in writing by HookWeb Design.

4. Subscription Access

Subscription access includes ongoing use of the system, automation functionality, support, maintenance, and related services as applicable to the selected plan.

Subscription fees may be billed monthly or annually depending on the plan selected.

5. 100-Day Performance Guarantee™

HookWeb Design offers a 100-Day Performance Guarantee™ on eligible subscription fees.

If the system is properly installed, active, and used as intended, and you do not see measurable improvement within 100 days of activation, you may request a refund under this guarantee.

Measurable improvement may include improvement in one or more of the following:

Lead response speed

Customer engagement

Recovered missed opportunities

Follow-up consistency

Lead capture activity

6. Guarantee Conditions

To qualify for the 100-Day Performance Guarantee™, all of the following must be true:

The system must be fully installed and active for at least 30 consecutive days

Calls, messages, forms, and/or leads must be routed through the system as instructed

Client must complete onboarding and provide required business information

Client must not disable, bypass, interfere with, or materially alter system functionality

Client must allow HookWeb Design a reasonable opportunity to review system activity and performance data

The guarantee applies to eligible subscription fees only. It does not guarantee specific revenue, profit, closed sales, or business growth.

7. Monthly Subscription Terms

Monthly subscription plans are billed monthly.

For monthly plans:

The $2,500 Launch Setup Fee is due separately and is non-refundable

If you qualify under the 100-Day Performance Guarantee™, monthly subscription fees paid during the eligible guarantee period may be refunded

Cancellation after the 100-day guarantee period stops future billing

No partial, prorated, or retroactive refunds are provided outside the guarantee terms

8. Annual Subscription Terms

Annual plans are billed upfront and run for the full committed term.

Launch Setup Fee Waiver

If you choose an annual subscription, the $2,500 Launch Setup Fee is waived upfront at the time of purchase.

100-Day Performance Guarantee for Annual Plans

If you qualify for cancellation under the 100-Day Performance Guarantee™:

The waived $2,500 Launch Setup Fee will be deducted from the annual payment to cover system buildout, onboarding, testing, and implementation

The remaining eligible balance of the annual subscription payment will be refunded

After the Guarantee Period

After the 100-day guarantee period ends, annual subscriptions are non-refundable and non-cancelable for the remainder of the term, unless otherwise agreed in writing.

9. Client Responsibilities

Client agrees to:

Provide accurate business information

Complete onboarding requirements

Use the system as intended

Maintain access to required tools, phone numbers, accounts, or integrations

Respond promptly to reasonable requests needed to complete setup or support

Failure to cooperate may delay implementation and may affect guarantee eligibility.

10. No Revenue Guarantee

HookWeb Design does not guarantee specific revenue, profit, sales volume, booked appointments, or closed deals.

The guarantee relates to system performance indicators, not final business outcomes.

11. SMS and Communication Compliance

Client is responsible for ensuring that its own customer communications comply with applicable laws, including consent requirements for SMS, phone, and automated communications.

HookWeb Design may provide tools and guidance, but client remains responsible for the accuracy of its customer lists, consent records, and business messaging practices.

12. Cancellation

Cancellation requests must be submitted in writing to HookWeb Design.

Cancellation stops future billing only after the applicable committed term or guarantee terms have been satisfied.

13. Limitation of Liability

HookWeb Design is not liable for indirect, incidental, consequential, special, or lost-profit damages, including loss of business, lost revenue, or lost opportunities.

14. Modifications

HookWeb Design may update these Terms from time to time. Updates will be posted with a revised “Last Updated” date.
